Each case has certain facts favorable to the Plaintiff and certain facts
favorable to the Defendant. The scope of the initial evaluation is to identify
those items that, necessarily, affect the outcome of the case and translate them
from legalese to understandable principals.

Identify the effort expended to position the case for trial. Review the
case history, and examine discovery products with case objectives.

Quantify items required for trial such as further depositions,
interrogatories, and motions. Establish the need for experts and provide cost
estimates for trial preparation, motions and trial times in order to determine
the costs to complete the litigation.

Compare settlement offers or projected settlement discussion against the
probability of recovery or projected liability to establish the value to the
client of pursuing the litigation.

Prepare report detailing the analysis discussed above and project
settlement values based upon the evaluation. Provide a critical path to settle
the conflict or complete the litigation.
